Abstract

The presidential ordinance, regulated by Articles 997–1002 of the Civil Procedure Code, allows the court to issue provisional measures during divorce proceedings in urgent cases, without affecting the merits of the case. Through this summary procedure, the parent who has actual custody of the child can request the reimbursement of allowances or the early enforcement of maintenance obligations. Parental rights and duties are equally shared between both parents, and decisions concerning the child should, in principle, be made jointly. The presidential ordinance thus ensures speed, protection of the child’s best interests, and balance between the parties.
