The Dynamics of Matrimonial Co-Management regarding Decision-Making Power and the Protection of Common Property in light of the Civil Code

The analysis of the scope and content of the rights of administration, use, and disposal that spouses exercise over common property remains an essential undertaking in the context of applying the new Civil Code. This necessity arises, on the one hand, from the evolution of the legal regime of the statutory community, which has incorporated and systematized the nuanced solutions developed in prior judicial practice, and, on the other hand, from the interaction of these rules with special legislation. The current legislative framework distinctly regulates acts of preservation and administration as opposed to acts of disposal, imposing clear limits on the exercise of these rights to ensure the protection of family interests.
