Abstract

Specialized literature has proposed multiple categories of the object of an infraction (general, generic, specific, direct, judicial, material), but these are considered artificial and unnecessary. The author argues that the essential concept is the general notion of the object of an infraction, defined as the social relation protected by criminal law and violated by the infraction.” Based on this general notion, for each specific infraction, the social relation that constitutes its object must be clearly identified.
