Comments On The General Criteria For The Individualisation Of The Penalty In A European Vision

In this article, we have sought to highlight what seems to us to be a guideline in penal policy, namely the orientation of our penal legislation towards harmonizing the repressive reaction, according to the criteria of individualization of punishment in a European vision, by seeking to reflect in the penalty imposed the previous behaviour of the offender, the seriousness of the offence and the extent to which the offender's personality has manifested itself in the offence, or the individualization of the penalty takes place from the perspective of the future, seeking through the penalty to bring about essential changes in the defendant's future behaviour. It follows that the past and the present are both taken together in the process of individualization, the judge assessing the seriousness of the offence committed and the way in which the defendant's personality is reflected in it, not only in order to satisfy principles of European law in relation to what the defendant has committed, but also in order to trigger, with the help of the criminal penalty and within the limits of the law, a process of transformation of the subject's conduct which will ensure, as a proximate objective, his abstention from committing further offences.
