The rules of criminal procedure govern the conduct of criminal proceedings and other judicial procedures about a criminal case.
The rules of criminal procedure aim to ensure the efficient exercise of the powers of the judicial bodies while guaranteeing the rights of the parties and other participants in the criminal proceedings to comply with the provisions of the Constitution, the Treaties establishing the European Union, other European Union regulations on criminal procedure and the covenants and treaties on fundamental human rights to which Romania is a party.
The criminal process, through the rules of criminal procedure, aims at the timely and complete establishment of the facts that constitute crimes, so that any person who has committed a crime is punished according to his guilt and no innocent person is held criminally responsible.
The rules of criminal procedure must contribute to the defense of the rule of law, the protection of the individual, his or her rights and freedoms, the prevention of crime, and the education of citizens to respect the law.
