Abstract

The criminal executive field implies clear rules regarding the entire activities undertaken to ensure the rights of persons deprived of liberty, and correlatively, to fulfill the obligations provided by law, so that the functionality of the system has consistency and legislative recognition both at national and international level. The mechanisms implemented are mainly document-based, physical presence, direct networking and measures accordingly. The digital part is an effective tool, but not absolute. The technique does not replace human presence, but facilitates the operability of the realization of the prerogatives established for the exercise of the rights of direct networking. The article will highlight ways of interfering with digitalization in relation to the effective enforcement of the rights of the carceral population, the advantages, disadvantages, limits of applicability, as well as recommendations for the future development of viable mechanisms of cohesion between artificial intelligence and the field of ensuring the rights of these categories of people in line with societal challenges and the protection of the confidentiality of personal data.
