Forensic Psychiatric Examination of Minors in the Context of the Debate on Lowering the Age of Criminal Responsibility

This paper aims to analyze the legal framework governing forensic psychiatric examinations of minors in Romania, in the context of recent debates concerning the possible reduction of the age of criminal responsibility from 14 to 12 years. The study is conducted in relation to the current legislative approach, according to which minors under the age of 14 do not bear criminal responsibility. The analysis is further developed through a comparative law perspective and by reference to the fundamental principles established in relevant international legal instruments concerning the protection of minors and the administration of juvenile justice.
