Clarifying the Concept of Fault and its Legal Implications in the Contemporary Normative Framework

The first part of the article defines the notion of criminal negligence (fault): an act is considered committed with fault when the perpetrator foresees the result of their conduct but does not accept it, wrongly assuming that it will not occur (negligence with foresight), as well as when the perpetrator does not foresee the result, although they should and could have foreseen it (simple negligence). Subsequently, the author analyzes the two fundamental forms of criminal negligence, namely imprudence and negligence, presenting the criteria used to distinguish between the modalities.
